Types of child custody arrangements in Fort Bend County, Texas

In Texas, child custody is known formally as conservatorship. What people colloquially call legal custody is a managing conservatorship. Therefore, if you have the authority to make decisions for your child’s health and welfare, you are a managing conservator. The responsibility for housing your child is determined under a standard possession order. Parental rights and responsibilities are defined by the following types of arrangements:

  • Joint managing conservatorship — The parents share authority for making decisions for the child’s health, education, and welfare. The order of possession may also provide for shared physical custody of the child.
  • Sole managing conservatorship — One parent makes all major decisions and usually has sole physical custody of the child.
  • Possessory conservatorship — When one parent is named sole managing conservator, the other parent has limited rights as a possessory conservator. The possessory conservator has possession and access to the child under a defined schedule in the order of possession and usually pays child support to the other parent.
