Reliable advocacy for child custody solutions in Spring, Texas

Most people think in terms of legal custody and/or physical custody of a child. But in Texas, the law contains more technical language. Terms you need to understand include:

  • Standard possession order — This court order makes one or both parents conservators of the child and includes a parenting time schedule for each.
  • Sole managing conservatorship — A managing conservator has the authority to make decisions for the child’s health, education and welfare. A sole conservatorship gives this power to one parent. This is the appropriate arrangement when the other parent is unfit or unavailable to be at least a part-time caregiver for the child.
  • Joint managing conservatorship — In this arrangement, parents share decision-making authority and often share physical custody of the child according to the terms of the parenting plan.
  • Possessory conservatorship — When one parent is the sole managing conservator, the court limits the other parent’s possession and access to the child and requires that parent to pay child support. The court allows this parent visitation according to the standard possession order. However, if contact with the parent would be contrary to the best interests of the child, the court can deny even a possessory conservatorship and prohibit visitation.

Texas family law requires the court to consider various factors before deciding what type of possession order serves your child’s best interests. As your counsel, we present evidence that shows these factors in a light favorable to your custody goals.

Sound management of child custody disputes during and after divorce

Rather than leaving the decision up to the court, many divorcing couples are able to negotiate a parenting plan as part of a marital settlement agreement, which they present to the court for approval. However, in many cases a negotiated settlement is neither possible nor appropriate. If the other parent refuses to be reasonable and insists on trampling your parental rights, we litigate aggressively in court to achieve the best possible outcome.

We also provide determined representation for parents in post-divorce custody disputes, which may include:

  • Modifications of standard possession orders
  • Allegations of parental alienation
  • Interference with parenting time
  • Unfit parenting and child endangerment
  • Relocation
  • Fathers’ custody rights
  • Visitation rights for grandparents

We understand that during your divorce and afterwards, nothing is more important than your relationship with your children. We understand your urgency and are determined to achieve positive results.
